Planning Board meeting minutes for Thursday November 7, 2013

The meeting was opened at 7:07 p.m.

Members present: Alan Salamon, Stephen Enoch, co-chair, Roger Tryon, Maggie Leonard, co-chair.

Members absent: Larry Klein, Barry Karson.

The board agreed to hold a public hearing on Saturday November 30th at 1:30 p.m. at the Town Hall for the solar power zoning bylaw and the medical marijuana moratorium in time for the special town meeting on December 6th.

The board discussed the length of time for the moratorium on medical marijuana clinics. Since we are bringing this before the town at a special town meeting the board thought it would be prudent to request a 17-month moratorium in order for the deadline for the zoning bylaw proposal to fall on the annual town meeting in May 2015. That would give the board 17 months to study the recommendations from the Mass Department of Public Health as well as learning about the issue locally.

The board reviewed the public hearing notice for The Berkshire Record that Leonard submitted for a public hearing on Saturday November 30th. After some wording changes the board approved the notice.

The board discussed the organization of the Zoning Bylaws with regard to where to put the solar power zoning bylaw. There is some confusion as to the purpose of Section 8.0 a blank section that is reserved for Special Districts. The board also discussed the protocol for the public hearing and special town meeting. Enoch suggested that we propose the zoning bylaw first and then tackle various sections with regard to use tables, etc.

The board reviewed the discussion from the prior meeting on October 24, 2013, to bring Leonard up to speed on the thinking about Accessory Dwelling Units (ADU’s). At the prior meeting the board discussed limiting ADU’s to one bedroom and to limit use to relatives.

The mail was opened. There were 2 notices for pubic hearings from Great Barrington.

There being no other business the meeting was adjourned at 8:30 p.m.
